Privacy Policy

This Privacy Policy explains how Ben's Fast Food Restaurants, Inc. ("Ben's Fast Food," "we," "us," or "our") collects, uses, and discloses information about you when you visit our brand websites — bensfastfood.com, eatpalmita.com, umamiexpress.co, and lotusandlime.com (each a "Site," together the "Sites") — contact us, or request catering. It also describes the privacy rights available to you.

This policy covers our own marketing websites only. When you place a food order, you leave our Sites and order through a separate third-party ordering service, including our online Storefront (powered by DoorDash) at order.online and other platforms such as Uber Eats, Grubhub, Doordash, or CaterCow. Your order and payment information is collected on those services, not on our Sites, and is governed by their own terms and privacy policies — including, for the DoorDash-powered Storefront, a separate Storefront Privacy Policy and Storefront Consumer Terms and Conditions presented to you at checkout (DoorDash acts as our service provider for the Storefront). We do not control those services. Please review the applicable policy before you order.

Our Sites are intended for users in the United States. We do not direct the Sites to, or knowingly collect information from, individuals in the European Union, United Kingdom, or other regions with separate data-protection regimes.

1. Information we collect

Information you give us directly. When you fill out a contact form, request catering, or otherwise reach out to us, we collect the information you choose to provide — typically your name, email address, phone number, company or event details, delivery or event location, and the contents of your message. For catering, this may include event date, headcount, budget, and dietary or menu preferences.

Information collected automatically. When you visit a Site, we and our analytics providers automatically collect certain technical information through cookies and similar technologies, including your IP address, device and browser type, operating system, referring/exit pages, pages viewed, links clicked, approximate location (derived from IP), and the dates/times of your visits. We use this to understand how visitors find and use our Sites.

We do not collect payment-card information on our Sites. Payments for orders are handled entirely by the third-party ordering platforms listed above.

We do not knowingly collect information from children under 13 (see Section 8).

2. Cookies and analytics

Our Sites are built on Squarespace and use cookies and similar technologies, including:

  • Google Analytics 4 and Google Tag Manager, to measure traffic and understand how visitors use our Sites;

  • Microsoft Bing and other search/analytics tools for the same purpose;

  • Squarespace functional cookies necessary for the Sites to operate.

These tools may set cookies that collect online identifiers and usage data. You can control cookies through your browser settings, through any cookie-preference controls we make available on the Sites, and you can opt out of Google Analytics via Google's opt-out browser add-on at https://tools.google.com/dlpage/gaoptout. We honor recognized browser-based opt-out preference signals (such as Global Privacy Control) where required by applicable law. Interest-based advertising. We do not currently serve targeted (interest-based) advertising on our Sites. If we do so in the future, we (or our advertising partners) may use cookies and similar technologies to deliver ads tailored to your interests across websites and devices. You will be able to opt out through your browser and device settings and through industry opt-out tools, including the Network Advertising Initiative (https://optout.networkadvertising.org), the Digital Advertising Alliance (https://optout.aboutads.info), and Google's Ads Settings (https://adssettings.google.com). Even after opting out, you may still see ads that are not tailored to your interests.

3. How we use information

We use the information we collect to:

  • respond to your inquiries and fulfill catering or contact requests;

  • operate, maintain, secure, and improve our Sites and our menus;

  • understand traffic and how customers discover our brands;

  • send you information you request and, where permitted, occasional updates about our brands (you can opt out at any time — see Section 6);

  • comply with legal obligations and enforce our terms; and

  • detect, prevent, and address fraud, security, or technical issues.

We rely on your consent, our legitimate business interests, and the need to respond to your requests as the bases for these uses, as applicable.

4. How we share information

We do not sell your personal information for money. We share information only as described here:

  • Service providers. With vendors who perform services for us — for example website hosting (Squarespace), analytics (Google), email, and catering logistics — who are permitted to use the information only to provide services to us.

  • Analytics and advertising partners. We share online identifiers and usage data with analytics providers (such as Google) to measure and improve our Sites. Under some state privacy laws, this type of sharing for analytics or cross-context advertising may be considered a "sale" or "sharing" of personal information. You can opt out as described in Sections 2 and 5.

  • Legal and safety. When we believe disclosure is required by law, legal process, or to protect the rights, property, or safety of Ben's Fast Food, our customers, or others.

  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

We do not share information with the third-party ordering platforms; rather, you provide your information to them directly when you order.

5. Your privacy rights

Depending on where you live (including California under the CCPA/CPRA, and states such as Virginia, Colorado, Connecticut, and Utah), you may have the right to:

  • know/access the personal information we hold about you;

  • delete your personal information;

  • correct inaccurate personal information;

  • opt out of the "sale" or "sharing" of personal information and of targeted advertising; and

  • not be discriminated against for exercising these rights.

California "Shine the Light." California residents may request information about disclosures of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing.

To exercise any of these rights, email us at hello@bensfastfood.com with the nature of your request. We will verify your request (for example, by confirming information associated with you) before acting on it, and we will respond within the timeframe required by applicable law. You may use an authorized agent where the law permits.

6. Communications and your choices

Email. If we send you marketing emails, you can opt out at any time using the unsubscribe link in the email or by contacting us at hello@bensfastfood.com. We will still send you non-marketing messages necessary to respond to your requests (for example, replying to a catering inquiry).

Text messages (SMS). If you provide your mobile number and agree to receive text messages from us, we may send you texts such as order, catering, or account updates and, where you have consented, promotional messages. Message and data rates may apply, and message frequency varies. You can opt out of texts at any time by replying STOP to any message, or by contacting us at hello@bensfastfood.com; reply HELP for help. Consent to receive texts is not a condition of any purchase. We do not sell or share your mobile phone number with third parties or affiliates for their own marketing or promotional purposes.

7. Data retention and security

We keep personal information for as long as needed to fulfill the purposes described in this policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. We use reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Children's privacy

Our Sites are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at hello@bensfastfood.com and we will delete it.

9. Third-party links, platforms, and our online Storefront

Our Sites link to third-party services, including social media and the ordering services described above. We are not responsible for the privacy practices or content of those third parties; their use of your information is governed by their own policies.

In particular, our online Storefront is powered by DoorDash. When you order through the Storefront, the information you provide there (including your order details and payment information) is collected and processed under the Storefront Privacy Policy and the Storefront Consumer Terms and Conditions made available to you on the Storefront, and under DoorDash's own policies, rather than this Privacy Policy. Those documents describe additional practices that apply to the Storefront (such as cookies, advertising technologies, and analytics used there) which do not apply to our marketing Sites.

10. Changes to this policy

We may update this policy from time to time. When we do, we will revise the "Last updated" date above, and, where required by law, provide additional notice. Your continued use of the Sites after an update means you accept the revised policy.
